GENERAL CONDITIONS OF SALE

Introduction

  1. The sale of products concluded remotely through this Site is governed by the following General Conditions of Sale. The product offered on this Site are sold directly by Rosso srl: a company with Italian law, with registered office in Via Regina Cornaro 221, 31011, Asolo (TV) Italia, VAT number 01873620262, registration number in the Register of Companies of Treviso TV-174483.
  2. These General Conditions of Sale are published on the Site in order to allow their knowledge and storage by the Customer in accordance with current legislation.
  3. The purchase is governed exclusively by the General Conditions of Sale published on the Site and takes effect from the time of purchase. Rosso srl reserves the right to make changes and/or additions to these General Conditions of Sale at any time. Any changes and/or additions will be effective in relation to purchases made after the publication date of the new version of the General Conditions of Sale.

Products availability

  1. The Customer acknowledges that the products offered on the Site (hereinafter referred to as “Products”) are numerically limited and are therefore aware that Rosso srl will have to check their availability at the time of purchase.
  2. Rosso srl reserves the right to respect the items offered on the site at any time, without notice.

Purchase procedure

  1. Each product offered for sale on the Site can be viewed through a special link, which allows you to view the images of the article, the description and the unit price.
  2. The products chosen by the customer will be included in a special section (hereinafter referred to as “Cart”).
  3. Although Rosso srl constantly adopts measures to ensure that the images shown on the Site faithfully reproduce the Products, some variations are always possible due to the technical and resolution characteristics of the device used by the Customer. Consequently, Rosso srl will not be responsible for any inadequacy of the graphic representations of the Products shown on the Site if due to the aforementioned technical reasons.
  4. The purchase procedure ends when the Customer selects the appropriate button of order confermation, thus validating his Order Proposal, which will be sent directly to Rosso srl, and makes the payment of the amount due.
  5. Before confirming the Order Proposal, the Customer must declare that he has read and accepted these Conditions of Sale. At the end of the purchase procedure, the Customer should save or print the General Conditions of Sale.
  6. The purchase procedure must be completed in full; otherwise, the Order Proposal cannot be sent to Rosso srl.
  7. Each Order Proposal and Customer data necessary for the purchase will be archived by Rosso srl for the period of time and in compliance with the conditions provided for by current legislation.
  8. The customer is aware of being responsible for the correctness and truthfulness of all data entered on the Site or used in the purchase phase.

Contract conclusion

  1. After the confirmation of the Order Proposal, the order is sent to Rosso srl for processing and cannot be further modified or canceled.The Order Proposal issued by the Customer will be taken over by Rosso srl only if the entire purchase procedure has been completed regularly, without any highlighting of error by the Site.
  2. The contract stipulated between Rosso srl and the Customer must be considered concluded and confirmed only when the Customer receives a confirmation email from Rosso srl. The confirmation email will be sent to the address indicated by the customer in the purchase form and will contain the confirmation and summary of the order.
  3. Rosso srl reserves the right not to accept the Order Proposal issued by a Customer in the following cases:

In the aforementioned hypotheses, Rosso srl will communicate to the Customer by email, within 14 (fourteen) days from the date of actual receipt of the Order Proposal, the possible cancellation of the orders received. In this case, no Order Proposal shall be deemed accepted by Rosso srl and no contract shall be considered concluded between Rosso srl and the Customer.

Price and payment method

  1. The prices of all the Products on the Site are inclusive of VAT and are indicated in Euros (EUR).
  2. For purchases on the Site, shipping is free only in EU and the price shown in the Cart, including VAT, is the total amount paid by the Customer, excluding the cash on delivery in Italy which entails an additional cost of 2€. In any case, if the event arises, Rosso srl will ask for the express consent of the Customer for any further additional costs.
  3. Rosso srl reserves the right to change the prices of the Products offered on the Site at any time without notice.
  4. Rosso srl only accepts payments by Bank Transfer, Credit Card or PayPal.
  5. For the purposes of payment by Credit Card, the customer confirms and guarantees that he is the owner of the credit card used for the purchase and correctness of all the data relating to it, entered during the purchase, such as number, expiry date and, if required, security code.
  6. The payment of the amount due by the Customer must be made within 48 working hours after sending the order.
  7. The shipment of the purchased Products will be made only after the payment of the amount due by the Customer has been successful.

In the event that, for any reason, the debit of the amounts due by the Customer proves impossible or not carried out within 48 hours, the sales process will be automatically canceled and the sale canceled, as communication that will be sent to the Customer.

Transactions Security

  1. Online credit card transactions are carried out in compliance with the security protocols provided by the international circuits Verified by Visa, Secure Code MasterCode and American Express which guarantee merchants immunity from fraudulent disclaimers. These protocols allow you to communicate in a way designed to avoid interception, modification or falsification of information.
  2. At no time during the purchase procedure Rosso srl is able to know the information relating to the Customer’s Credit Card or the Customer’s financial information, as they are entered directly on specific platforms or on the website of the bank that manages the transactions; since there is no data transmission, there is no possibility that these will be intercepted. No computer archive of Rosso srl contains or stores such data. In no case, Rosso srl can therefore be held responsible for any fraudulent and undue use of Credit Cards by third parties, when paying for purchased products.
  3. If for payment the customer uses a card with 3D SECURE protection activated, he must have activated the appropriate service (for details see the website www.cartasi.com).

Delivery

  1. For security reasons, Rosso srl will not process any order addressed to a post office box and will not accept any order in which it is not possible to identify the individual recipient of the order and its address.
  2. In accordance with current legislation, the maximum term within which Rosso srl will have to deliver the purchased Products is 30 (thirty) days from the date of conclusion of the contract, except for events of force majeure.
  3. If Rosso srl does not deliver the Products ordered within the aforementioned period, the Customer must ask Rosso srl to make the delivery within an additional period appropriate to the circumstances, in accordance with current legislation. The right of the Customer to immediately terminate the contract is reserved if the ordered Product is not delivered within the additional term indicated.
  4. The Customer will assume the risk of loss or damage to the Products only when the same, or a third party designated by him and different from the courier, physically enters into possession of such Products.

Returns and Refunds

  1. The Customer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the Products, except in the case of Customized Products.
  2. The Customer can request the return of the Products by sending an email to info@rossogioielleria.com, indicating your data, the order number and the reason for the return.
  3. The shipping costs for returning the Products are € 25 and will be subtracted from the amount to be returned to the Customer.
  4. The Customer undertakes to return the Products for which he exercised the right of withdrawal without undue delay and, in any case, within 14 (fourteen) days from the date on which he communicated to Rosso srl his decision to withdraw from the contract.
  5. The Products must be returned in the same state in which they were delivered. The Customer must therefore make sure that the Products are intact and complete, never used or damaged in any way, and that they are returned in their original packaging. Rosso srl will verify the packaging and condition of the returned Products, constituting their substantial integrity, an essential requirement for exercising the right of withdrawal. Rosso srl reserves the right to refuse the return of those Products that are found to be damaged, deteriorated or are in a state such as to imply, unequivocally, that they have been used. In case of refusal of the return, Rosso srl will send a specific communication to the Customer and will not proceed to re-credit the price paid by the same, also reserving the right to request compensation for any damage attributable to the Customer’s conduct.
  6. The refund of the price of the returned Products will be carried out by Rosso srl without undue delay and in any case within 14 (fourteen) days from the date on which Rosso srl became aware of the exercise of the right of withdrawal by the Customer. Rosso srl reserves the right to withhold the refund until it has received and verified the Product. The aforementioned refund will be made by crediting the amount paid by the Customer, excluding the shipping costs of the returned product (€ 25.00), to be carried out with the same payment method used for the purchase, unless the Customer has expressly agreed otherwise. Rosso srl will confirm the refund of the price to the customer by email.
  7. The return of the Products pursuant to this article is allowed only in relation to purchases on the Site.
  8. In consideration of the fact that the Customized Products are permanently modified and customized specifically for the Customer and that their original production cannot be restored, the right of withdrawal cannot be exercised by the Customer. Consequently, the provisions contained in this article do not apply to Customized Products, it being understood that this will not affect the application of the legal guarantees provided on all Products.

Disclaimer

  1. Except in cases of willful misconduct or gross negligence, Rosso srl will in no way be liable to the Customer for indirect or consequential damages that may arise from the purchase of the Products offered for sale on the Site.

Products authenticity

  1. Rosso srl guarantees the authenticity and high quality of all the Products offered for sale on the Site.

Disputes

  1. These General Conditions of Sale are governed by Italian law and will be interpreted on the basis of it, without prejudice to any other mandatory rule, more favorable to the customer.
  2. In the event of a dispute arising from the interpretation and / or application of the previous General Conditions of Sale, the Court of Treviso will have exclusive and mandatory jurisdiction.
